GRADEINSTANT TERMS OF SERVICE

CHAPTER I

GENERAL PROVISIONS

These Terms of Service ("Terms") govern your use of the GradeInstant platform, an AI-powered coding assignment review system operated by JSC "Taikomasis dirbtinis intelektas" ("Company," "we," "us," or "our").

By accessing or using the GradeInstant platform at app.gradeinstant.com, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the platform.

CHAPTER II

ACCEPTANCE AND MODIFICATION OF TERMS

By creating an account or using the GradeInstant platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the platform. Your continued use of the platform after any changes constitutes your acceptance of the modified Terms.

We will make reasonable efforts to notify users of significant changes to these Terms through email notifications or platform announcements.

CHAPTER III

USER ACCOUNTS AND REGISTRATION

Account Creation: To use certain features of the platform, you must create an account by providing accurate and complete information, including your name, email address, and educational institution affiliation.

Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

Account Types:

• Instructor Accounts: Authorized to create assignments, invite students, and access performance analytics
• Student Accounts: Authorized to receive assignments, submit code, and take generated quizzes

Eligibility: You must be at least 13 years old to use the platform. If you are under 18, you represent that you have obtained parental or guardian consent to use the platform.

CHAPTER IV

PLATFORM USAGE AND CONDUCT

Permitted Use: The GradeInstant platform is intended solely for educational purposes related to coding instruction and assessment. You may use the platform to:

• Create and distribute coding assignments (Instructors)
• Submit code solutions and complete assessments (Students)
• Access performance analytics and educational insights
• Collaborate within educational contexts

Prohibited Conduct: You agree not to:

• Use the platform for any unlawful purpose or in violation of these Terms
• Submit or share malicious code, viruses, or harmful software
• Attempt to gain unauthorized access to other users' accounts or data
• Interfere with or disrupt the platform's functionality
• Use the platform to cheat or facilitate academic dishonesty
• Share account credentials with unauthorized parties
• Upload content that infringes on intellectual property rights
• Submit content that is offensive, discriminatory, or inappropriate for educational settings

CHAPTER V

INTELLECTUAL PROPERTY AND CONTENT

Platform Ownership: The GradeInstant platform, including all software, algorithms, user interfaces, and AI technology, is owned by the Company and protected by intellectual property laws.

User Content: You retain ownership of any code, assignments, or other content you submit to the platform. By using the platform, you grant us a limited license to process your content solely for the purpose of providing our services.

AI-Generated Content: Quizzes, assessments, and feedback generated by our AI system are provided as educational tools. While we strive for accuracy, you acknowledge that AI-generated content may contain errors and should be used as supplementary educational material.

Code Submissions: Student code submissions are processed by our AI for educational assessment purposes only. We do not claim ownership of submitted code and implement security measures to protect intellectual property.

CHAPTER VI

SERVICE AVAILABILITY AND MODIFICATIONS

Service Availability: We strive to maintain platform availability but do not guarantee uninterrupted access. The platform may be temporarily unavailable due to maintenance, updates, or technical issues.

Service Modifications: We reserve the right to modify, suspend, or discontinue any aspect of the platform at any time with reasonable notice to users.

Beta Features: Some platform features may be offered in beta or testing phases. These features are provided "as-is" and may be modified or removed without notice.

CHAPTER VII

DATA SECURITY AND PRIVACY

Security Measures: We implement industry-standard security measures to protect user data, including encryption, secure data transmission, and access controls.

Data Processing: All personal data processing is governed by our Privacy Policy and applicable data protection laws, including GDPR.

Data Retention: We retain user data only as long as necessary to provide our services and comply with legal obligations, as specified in our Privacy Policy.

Educational Records: We understand the sensitive nature of educational data and implement additional safeguards for student performance information and code submissions.

CHAPTER VIII

LIMITATION OF LIABILITY

Service Disclaimer: The GradeInstant platform is provided "as-is" without warranties of any kind, either express or implied. We do not guarantee the accuracy, completeness, or reliability of AI-generated assessments.

Educational Tool: The platform is designed as an educational support tool. Final grading decisions and academic evaluations remain the responsibility of instructors and educational institutions.

Limitation of Damages: To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform.

Maximum Liability: Our total liability for any claims related to the platform shall not exceed the amount you have paid for the services in the 12 months preceding the claim.

CHAPTER IX

TERMINATION

Termination by Users: You may terminate your account at any time by contacting us or using the account deletion feature in the platform.

Termination by Company: We may suspend or terminate your account if you violate these Terms, engage in prohibited conduct, or for any other reason with reasonable notice.

Effect of Termination: Upon termination, your access to the platform will cease, and we may delete your account data in accordance with our Privacy Policy and data retention policies.

CHAPTER X

GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the Republic of Lithuania.

Any disputes arising from these Terms or your use of the platform shall be resolved through the courts of the Republic of Lithuania.

For EU residents, nothing in these Terms affects your rights under applicable consumer protection laws.
